1. GENERAL

This document is an electronic record published in accordance with the applicable provisions of the Information Technology Act, 2000 and the rules framed thereunder, and the Digital Personal Data Protection Act, 2023 (“DPDP Act”). This electronic record is generated by a computer system and does not require any physical or digital signature.

2. PERSONAL INFORMATION WE COLLECT

2.1. Personal Information 

The term “Personal Information” for the purposes of this Policy shall mean any information relating to a natural person that, directly or indirectly, in combination with other information available or likely to be available with a body corporate, is capable of identifying such person.

2.2. Sensitive Personal Information

The term “Sensitive Personal Information” for the purposes of this Policy shall include personal data, such as financial or payment instrument details. We collect and process such information only to the extent necessary to provide our services, and in accordance with the applicable law.

2.3. Device Information 

Whenever a Customer visits the Website, we automatically collect certain information about the Customer’s device, including its IP address, browser type, time zone, and the web pages or Products viewed, using:

(a) “Cookies” are data files placed on the Customer’s device (see Section 10 below);
(b) “Log files” track actions on the Website and collect data such as IP address, browser type, internet service provider, and referring/exit pages;
(c) “Web beacons, tags, and pixels” which are electronic files used to record data about how a Customer browses the Website; 

(d) any other similar technology for the same purpose.

2.4. Order Information

When a Customer places or attempts to place an Order, or otherwise avails our services, we collect the following information pertaining to the Customer

(a) Customer’s name;

(b) registered account information, including User ID and password, if applicable;

(c) billing and shipping address;

(d) payment information (processed via our payment gateway partners, as described in Section 6);

(e) email address and phone number;

(f) any other information reasonably required to fulfil the Order or register the Customer on the Website.

2.5. Consent to collection of information

When a Customer interacts with the Website and provides “Personal Information” to us, they consent to our collection and usage of such information for the purpose of effectively providing our services.

3. HOW WE USE PERSONAL INFORMATION

3.1. Usage of Device Information

We use the Device Information we collect to help screen for potential risk and fraud, to understand how Customers interact with the Website, and to analyse this data to improve and optimise the Website and our services.

3.2. Usage of Order Information

We use Order Information to fulfil the Order placed by the Customer, including processing payment, arranging shipping and delivery, coordinating returns and exchanges, and providing Order Confirmations and Invoices. Further, we also use it to:

(a) communicate with the Customer;

(b) screen Orders for potential risk of fraud;

(c) where separately consented, provide the Customer with marketing communications or offers; and

(d) otherwise improve the shopping experience.

3.3. Usage of Personal Information for Secondary Purposes

Where we intend to use the Personal Information of a Customer for a secondary purpose, such as marketing, we will separately seek the explicit consent of the Customer and also provide a clear means to opt out.

4. ACCURACY OF INFORMATION

A Customer agrees to provide accurate, complete, and truthful information when using the Website. We reserve the right to request documentary proof of identity where reasonably necessary, and may refuse registration or restrict access to the Website where information provided is found to be false, incomplete, or misleading.

5. DISCLOSURE AND SHARING OF INFORMATION

5.1. Scope of sharing of Information

We share the Personal Information of a Customer with third parties only to the extent necessary to provide our services, as described in this Policy.

5.2. Website platform

The Website for Koda is hosted through a third-party e-commerce platform provider, which stores the data of the Customer on its secure servers in accordance with its own terms and privacy practices.

5.3. Analytics

We may use analytics tools (such as Google Analytics) to understand how Customers use the Website. The privacy practices of such third-party Service Providers will apply to the information processed by them.

5.4. Payment gateways

Parts of the Customer’s Personal Information pertaining to payments is shared with our third-party payment gateway partners for processing the payment. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by us and our third party service providers. 

5.5. Logistics Partners

Personal Information is shared with our Logistics Partners to facilitate delivery, pick-up, returns, and exchanges, in accordance with our Delivery and Shipping Policy and Cancellation, Return and Exchange Policy.

5.6. Sharing of Information with Third Parties

(a) We may disclose limited Information to third parties solely to diagnose technical issues, administer the Website, or improve our services.

(b) We may engage other third-party service providers to support our operations and improve Customer experience; 

(c) Once a Customer leaves our Website or is redirected to a third-party website or application, they are no longer governed by this Policy, and we are not responsible for the privacy practices of such third parties.

(d) Some service providers may be located in or have facilities that are located in a different jurisdiction than the Customer or us. Once a Customer elects to proceed with a transaction that involves the services of a third-party service provider, then their information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

5.7. Legal disclosure of Personal Information

We may disclose your personal information where required by applicable law, in response to a valid request from a government or judicial authority, or where we believe in good faith that disclosure is reasonably necessary to protect our legal rights or the safety of any person.

5.8. Permitted Use

We may use any feedback, reviews, or comments shared by Customers with us for legitimate business purposes, including on our Website or marketing materials, unless they request otherwise.

6. BEHAVIOURAL ADVERTISING

6.1. Advertising & Marketing

Where the consent of the Customer is provided, we may use their Personal Information to provide targeted advertisements or marketing communications across digital platforms, including Meta (Facebook/Instagram), Google, and YouTube.

6.2. Option to Unsubscribe

To unsubscribe or opt out of targeted marketing, the Customer can contact us at contact@kodafurniture.com.

6.3. Newsletter

Where the Customer subscribes to our newsletter, we process their name and email address for that limited purpose. The Customer may withdraw this consent at any time by writing to us at [email here]; doing so will not affect their ability to otherwise use the Website.

7. DO NOT TRACK

We do not currently alter our data collection practices in response to a “Do Not Track” signal from the Customer’s browser.

8. THIRD-PARTY LINKS

Our Website may contain links to other websites. We are not responsible for the privacy practices of such third-party sites and encourage the Customer to review their privacy policies independently.

9. SECURITY

We implement reasonable security practices and procedures in accordance with the applicable law, including encryption of payment information using secure socket layer (“SSL”) technology and PCI-DSS-compliant handling of card data. While no method of transmission over the internet is entirely secure, we take reasonable steps to protect the personal information of the Customer from unauthorised access, loss, misuse, or disclosure.

10. COOKIES

Our Website uses cookies as described in Section 2.3 to store non-sensitive information for technical administration, research, and improving the quality of our services. In respect of the same:

(a) We may use third-party Cookies to understand visitor behaviour; such Cookies do not store the personal information of the Customer and such Personal Information is not disclosed to third parties beyond what is necessary for their function.

(b) The Customer may disable or clear cookies through their browser settings; doing so may affect certain Website functionalities, including their ability to complete a purchase.

11. DATA RETENTION

We retain the Order Information for as long as reasonably necessary to fulfil the purposes described in this Policy, including recordkeeping, legal, accounting, and reporting obligations. The Customer can request a change, update, or deletion of their information, by contacting us at [email here], subject to Section 12 below.

12. AGE OF CONSENT

By using this Website, the Customer represents that they are at least 18 years of age, or that they are accessing the Website under the supervision of a parent or lawful guardian who consents to such use on their behalf.

14. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, regulatory, or operational reasons. Changes will take effect upon posting on the Website, and we encourage Customers to review this Policy periodically. In the event of Koda being acquired by or merged with another entity, the information of the Customers may be transferred to the new entity so that we may continue to provide our services.

15. GOVERNING LAW AND JURISDICTION

This Privacy Policy shall be governed by and construed in accordance with the laws of India. The courts at Hyderabad, India shall have exclusive jurisdiction over any disputes arising in relation to this Policy.
