By visiting our Website and/or purchasing anything from us, the Customer engages in our services (“Service”) and agrees to be bound by these Terms of Use (“Terms”), including any additional terms, conditions, and policies referenced herein or available by hyperlink, including but not limited to our Cancellation, Return and Exchange Policy, Delivery and Shipping Policy, and Privacy Policy.
1.3. These Terms apply to all Users (“Customer”) of the Website, including browsers, vendors, Customers, and contributors of content.
1.4. By accessing or using any part of the Website, the Customer agrees to be bound by these Terms. If the Customer does not agree to all the terms and conditions herein, they may choose to not access the Website or avail any of our Services.

3.2. The Customer understands that their data (excluding payment information) may be transmitted over various networks and may be altered to conform to technical requirements of the connecting networks or devices. Any payment information being transmitted will always be encrypted.

6. PRODUCTS AND SERVICES
6.1. All Products are made-to-order and may be available in limited quantities and are subject to returns or exchange solely in accordance with our Cancellation, Return and Exchange Policy.
6.2. We make every reasonable effort to display Product colours and images accurately; however, we cannot guarantee that the display will reflect the accurate colour of a Product.
6.3. We reserve the right to limit the sale of our Products to any person, geographic region, or jurisdiction, on a case-by-case basis. All Product descriptions and pricing are subject to change at any time without notice, at our sole discretion.
6.4. We do not warrant that the quality of any Products, services, or information obtained by the Customer through the Website will meet their specific expectations.
7. ACCURACY OF BILLING AND ACCOUNT INFORMATION
7.1. We reserve the right to refuse or cancel any Order, including where we suspect an Order has been placed by dealers, resellers, or distributors, or where multiple Orders are placed using the same account, payment method, or address. When we cancel or modify an Order, we will notify the Customer using the contact details provided at the time of placing the Order.
7.2. The Customer agrees to provide current, complete, and accurate account and purchase information, and to promptly update such information, including their email address and payment details, so that we may process the transactions and contact the Customer as needed.
8. OPTIONAL THIRD-PARTY TOOLS
8.1. We may provide access to third-party tools over which we have no control. Such tools are provided “as is” and “as available”, without warranties of any kind, and without endorsement by us. We shall have no liability arising from the Customer’s use of such tools.
8.2. Any use of optional third-party tools is at the Customer’s own risk, and the Customer is advised to review the terms of the relevant third-party Service Provider before use.

10.3. The Customer agrees that their Comments will not violate any third party’s rights, contain unlawful or abusive material, or contain any virus or malware. The Customer is solely responsible for any Comments they submit and their accuracy; we assume no liability for Comments posted by a Customer or any third party.

12. ERRORS, INACCURACIES, AND OMISSIONS

We reserve the right to correct such errors and to update information or cancel Orders arising from such inaccuracies, at any time, including after an Order has been submitted.

In no event shall Koda, its directors, officers, employees, affiliates, agents, or Service Providers be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, revenue, or data, arising from the Customer’s use of the Service or any Products procured through us, whether based in contract, tort, or otherwise, even if advised of the possibility of such damages. Nothing in this Section shall exclude or limit liability that cannot be excluded or limited under applicable Indian law, including in respect of gross negligence or wilful default.
15. INDEMNIFICATION
15.1 The Customer agrees to indemnify and hold harmless Koda, its parent, subsidiaries, affiliates, officers, directors, agents, and employees from any claim or demand, including reasonable legal fees, made by any third party arising from the Customer’s breach of these Terms or violation of any law or third-party rights.
16. SEVERABILITY
16.1 If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the remainder shall be severed without affecting the validity of the remaining provisions.
17. TERMINATION
17.1. These Terms remain effective unless and until terminated by us in writing. The Customer may terminate the application of these Terms at any time by ceasing to use the Website.
17.2. If we determine, in our reasonable judgment, that the Customer has failed to comply with these Terms, we may terminate this agreement and deny the Customer access to the Service, without notice.
17.3. Obligations and liabilities incurred by either party prior to termination shall survive termination.
18. ENTIRE AGREEMENT
18.1. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such a right or provision.
18.2. These Terms, together with our Cancellation, Return and Exchange Policy, Delivery and Shipping Policy, and Privacy Policy, constitute the entire agreement between the Customer and us governing their use of the Service, superseding any prior agreements or communications, whether oral or written.
19. GOVERNING LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with the laws of India. The courts at Hyderabad, India shall have exclusive jurisdiction over any disputes arising in connection with these Terms.
